SALES CONTRACT

Article 1: Purpose
The general sales conditions explained below detail the rights and obligations of TESETTUR PARIS and its customer in the context of the sale of the following goods: dress, topcoat, suit, jacket, trench coat, overalls, combination, skirt, tunic, blouse, shirt, scarf, shawl, trousers. Therefore, any service performed by the company TESETTUR PARIS means that the buyer accepts these general conditions of sale without reservation.

Article 2: Price
The prices of the goods sold are the prices in effect on the day the order is received. The currency is in euros and they are calculated tax-free. As a result, the VAT rate and shipping costs applicable on the day of the order will increase. TESETTUR PARIS has the right to change its prices at any time. However, it undertakes to invoice the ordered goods at the prices specified during the registration of the order.

Article 3: Discounts and campaigns
Recommended prices include discounts and campaigns that TESETTUR PARIS should give, taking into account the results or assumption by the buyer of certain services.

Article 4: Discount
There will be no discount in case of early payment.

Article 5: Payment terms
Orders are paid for: either by bank card; or by Paypal.

Article 6: Late payment
If the goods delivered are not fully or partially paid for on the day of receipt, the buyer must pay TESETTUR PARIS a delay penalty equal to three times the legal interest rate. The legal interest rate used is in effect on the day the goods are delivered. As of January 1, 2015, the legal interest rate will be revised every 6 months (Order No. 2014-947 dated August 20, 2014). This penalty is calculated including tax on the remaining amount due and is effective from the expiry date of the price without prior notice. In addition to late payment compensation, any amount including the deposit not paid by the due date will automatically result in a lump sum compensation of 40 euros due to collection costs. 441-6 of the Commercial Code. Article, paragraph 12 and D. 441-5.4

Article 7: Cancellation condition
If the buyer has not paid the amounts due within fifteen days following the application of the "late payment" condition, the sale will be automatically canceled and damages will be incurred to the benefit of TESETTUR PARIS.

Article 8: Retention of title clause
TESETTUR PARIS retains ownership of the goods sold until the full price is paid in principal and accessories. Therefore, if the buyer is subject to a receivership or compulsory liquidation, the company TESETTUR PARIS reserves the right to claim, within the framework of the collective procedure, the sold and unpaid goods.

Article 9: Delivery
Delivery is made when payment is valid; either direct delivery of the goods to the buyer; either by sending a notice of judgment in the store to the buyer's attention; or at the location specified by the buyer in the order form. The delivery time specified when registering the order is for informational purposes only and is in no way guaranteed. As a result, a reasonable delay in the delivery of the products may not lead to the buyer's benefit: compensation for damages; cancellation of the order. Shipping risk belongs entirely to the buyer. If goods are missing or damaged during transportation, the buyer must make all necessary reservations in the order form upon receipt of the goods in question. These reservations must be confirmed in writing by AR letter within five days of delivery.

Article 10: Force majeure
The liability of TESETTUR PARIS does not apply if the failure to fulfill or the delay in the implementation of one of its obligations described in these general sales conditions is caused by a force majeure situation. Therefore, force majeure means any external, unpredictable and irresistible event within the meaning of Article 1148 of the Civil Code.

Article 11: Competent court
Any disputes regarding the interpretation and fulfillment of these general conditions of sale are subject to French law. If an amicable decision is not taken, the dispute will be brought to the Commercial Court.
